Terms of Service

1. Agreement to Terms

By downloading, accessing or using Pencil Sketch (previously offered as Sketchpage) ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App.

These Terms constitute a legally binding agreement between you and Muntean Holding AS, a Norwegian company ("Company", "we", "us", or "our"). Please also read our Privacy Policy, which explains how we handle your data.

2. Description of Service

Pencil Sketch is a mobile application that uses artificial intelligence (AI) to turn photos that you choose or take into sketches in a range of styles, and into coloring pages that you can color in the App.

To create a result, the photo you choose is sent over an encrypted connection to our servers and from there to OpenAI, which generates the image. Details are in our Privacy Policy.

3. Eligibility, Accounts and Conduct

3.1 Anonymous Account: You do not need to register with an email address, name or password. When you first open the App, we create an anonymous account for you and give it a random user ID. Your credits, usage counters and subscription status are linked to that ID. Because the account is anonymous, we may not be able to restore it if you delete the App, reset your device or switch to a new device (see Section 7).

3.2 Age and Store Terms: The App is not directed to children. You must be at least 13 years old (or at least 16 years old if you live in the European Economic Area) to use it, and, where you are below the age of majority in your country, you need the permission of a parent or guardian to make purchases. Your download and purchases are also subject to the terms of the Apple App Store or Google Play Store. For iOS, Apple's standard Licensed Application End User License Agreement also applies. Apple and Google are not parties to these Terms and are not responsible for the App.

3.3 Your Photos: You may only upload or take photos that you own or have the right and permission to use, and that show people only where you are entitled to use their image. You are responsible for the photos you choose and for how you use and share the results.

3.4 Prohibited Uses: You agree not to:

  • Use the App for any illegal purpose or in violation of any laws
  • Upload content that infringes on third-party intellectual property, privacy or other rights
  • Upload content that is unlawful, sexually explicit, defamatory, obscene, threatening, hateful, abusive or harassing, or that depicts the sexual abuse or exploitation of children
  • Try to get around the App's limits, for example by creating multiple accounts to collect free credits, using automated tools or fake ad views to earn credits, or abusing the fair use limit
  • Attempt to interfere with, compromise, reverse engineer or extract the prompts, styles or other server logic of the App
  • Use the App to transmit viruses, malware, or other harmful code
  • Impersonate any person or entity or misrepresent your affiliation
  • Use the App to violate the usage policies of OpenAI or of the Apple App Store or Google Play Store

Images may be refused automatically by safety systems (ours or OpenAI's). If a request is refused, the credit used for it is returned (see Section 4.4).

4. Credits, Free Use and Rewarded Ads

4.1 Credits: Creating a sketch or a coloring page uses one credit. Each new account receives one free credit. Credits have no cash value, cannot be sold, transferred or exchanged for money, and are tied to your anonymous account.

4.2 Rewarded Ads: You can earn more credits by watching rewarded ads, which are provided by Google AdMob. The number of ads needed for one credit is shown in the App and may differ between countries. To prevent abuse, we limit how often and how many ads can count toward credits (for example, per day). Ads are shown only if your consent choices allow it (see our Privacy Policy). If no ad is available, you may not be able to earn a credit at that moment.

4.3 Free Results: Results created with free credits carry a watermark, and some styles, coloring palettes, resolution options and other features are available only with Pencil Sketch Pro.

4.4 Failed Requests: A credit is used when a result is successfully created. If a request fails, is blocked by a safety check or cannot be completed, the credit is automatically returned to your account. A credit that has been used for a result that was created successfully is not returned because you are dissatisfied with how the result looks (see Section 6).

5. Pencil Sketch Pro Subscriptions

5.1 What Pro Includes: Pencil Sketch Pro is an optional paid subscription. While it is active, it removes the watermark from your results, unlocks all sketch styles and coloring palettes, enables full-resolution output, and removes ads. Features may be added or changed over time.

5.2 Plans and Prices: Pro is offered as a monthly subscription and a yearly subscription. (Earlier weekly subscriptions continue until cancelled.) The price, billing period and currency for your country are shown in the App before you confirm a purchase, and include any applicable taxes where the store requires it.

5.3 Lifetime Watermark Removal: Instead of a subscription you can make a one-time purchase that removes the watermark from the pictures you save or share from the App. It is paid once, does not renew, and does not include the other Pro features (such as Magic and coloring page generation, which still need credits or Pro). You can restore it on a new device with the same Apple ID or Google account using Restore purchases. The price for your country is shown in the App before you confirm.

5.4 Payment and Automatic Renewal: Payment is charged to your Apple ID account or Google Play account when you confirm the purchase. Subscriptions renew automatically for the same period and at the then-current price until you cancel. Your account is charged for the renewal within 24 hours before the end of the current period. To avoid being charged for the next period, you must cancel at least 24 hours before the current period ends.

5.5 How to Manage or Cancel: You can view, manage and cancel your subscription at any time in your Apple ID subscription settings (on your iPhone or iPad: Settings, your name, Subscriptions) or in Google Play (Play Store, your profile, Payments and subscriptions, Subscriptions). Deleting the App does not cancel your subscription. After you cancel, you keep Pro until the end of the period you have already paid for. We cannot cancel store subscriptions for you, because they are managed by Apple or Google.

5.6 Price and Plan Changes: We may change prices or plans. Changes apply to future billing periods only, and where the law or store rules require it, Apple or Google will notify you and ask for your consent before the new price applies. If you do not agree with a change, you can cancel before the renewal.

5.7 Fair Use: Pro includes a fair use limit on the number of results you can create per calendar month. The limit is designed so that normal personal use is not affected, and the current limit is shown in the App. If you reach it, you may need to wait until the next month before creating more results.

5.8 Subscription Status and Restoring Purchases: We use RevenueCat to manage subscription status. RevenueCat receives your anonymous user ID and your purchase information from the store. If you reinstall the App or use a new device, use the "Restore" option in the App (on the paywall or in your Profile) to restore your subscription with the same Apple ID or Google Play account.

5.9 Subscriptions From Earlier Versions: If you have an active subscription that you bought in an earlier version of the App (Sketchpage), it remains managed through the same store, and it continues to give you Pro access in the App while it is active.

6. AI-Generated Content and Quality Disclaimer

IMPORTANT NOTICE ABOUT AI-GENERATED CONTENT:

Pencil Sketch uses artificial intelligence (AI) technology to transform photos into sketches and coloring pages. By using the App, you acknowledge and agree that:

  • No Guarantee of Quality or Accuracy: We do not guarantee that AI-generated images will be accurate, of satisfactory quality, or meet your expectations. AI-generated content is inherently unpredictable and results may vary.
  • Subjective Results: The quality and style of generated sketches is subjective and depends on various factors including input image quality, AI processing, and personal preferences.
  • Imperfections: Generated images may contain errors, distortions, artifacts, missing or invented details, or other imperfections, and may not look exactly like the photo you provided. Results are not suitable for uses where accuracy of likeness or detail is critical.
  • Results Differ: The same photo and settings can produce different results each time.

Dissatisfaction with how a successfully created result looks does not by itself entitle you to have a credit restored. This does not limit any rights you have under mandatory consumer law, or the automatic return of credits for failed requests described in Section 4.4.

7. Local Storage of Your Sketches

IMPORTANT NOTICE ABOUT DATA LOSS:

Your sketches and coloring pages are stored on your device only. We do not keep a copy of your photos or results on our servers and we do not offer cloud storage, backup or sync. By using the App, you acknowledge and understand that:

  • Deleting the App Deletes Your Sketches: If you delete the App, the sketches, coloring pages and coloring progress stored in it are removed with it, and we cannot recover them.
  • No Cloud Backup: Your content is not backed up by us. Whether it is included in your device's own backup depends on your device settings, which we do not control.
  • Anonymous Account: Your credits are stored on our servers and linked to your anonymous account on the device. If you delete the App, reset your device or move to another device, you may lose access to your anonymous account and its unused credits, and we may not be able to restore them. Your Pro subscription can be restored with the same Apple ID or Google Play account (see Section 5.8).

YOU ARE RESPONSIBLE FOR SAVING THE RESULTS YOU WANT TO KEEP, FOR EXAMPLE BY SAVING THEM TO YOUR DEVICE'S PHOTO LIBRARY OR SHARING THEM, BEFORE YOU DELETE THE APP.

Muntean Holding AS is not liable for any loss of sketches or other locally stored content resulting from deleting the App, device changes, or any other circumstances outside our control, to the extent permitted by law.

8. Refunds

8.1 Store Purchases: All purchases are made through the Apple App Store or Google Play Store, and the store, not us, receives your payment and handles refunds. Refund requests are decided by Apple or Google under their own policies. You can request a refund from Apple at reportaproblem.apple.com or from Google through your Google Play purchase history. We cannot issue refunds for store purchases ourselves, but we may support a refund request if the store asks us to.

8.2 Cancellation: Cancelling a subscription stops future renewals. Unless the store decides otherwise, it does not refund the current billing period, and you keep Pro until that period ends.

8.3 Your Statutory Rights: Nothing in these Terms limits any mandatory consumer rights you may have under the law where you live, including any right of withdrawal or legal guarantees that cannot be waived.

9. Intellectual Property Rights

9.1 Company Rights: The App, including its design, styles, text, software and other content (other than your content), is owned by Muntean Holding AS or its licensors and is protected by international copyright, trademark, and other intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App in accordance with these Terms.

9.2 Your Content: You retain ownership of the photos and images you choose or take. By using the App, you grant us, and the service providers that we use to run the App (including OpenAI), a limited, worldwide, non-exclusive license to process and transform your content for the sole purpose of creating the result you requested and operating the service. We do not keep your photos or results on our servers after your request is complete.

9.3 Generated Content: We do not claim ownership of the sketches and coloring pages that the App creates from your photos. As between you and us, you may use them subject to these Terms, the OpenAI terms that apply to the output, applicable law, and the rights of third parties in your original photo. Because AI-generated images may resemble existing works or people, we cannot guarantee that a result is free from third-party rights, and you are responsible for checking that your use of a result, in particular any commercial use, is lawful. These Terms do not contain a separate license for, or a prohibition of, commercial use of generated images.

9.4 Content From Earlier Versions: Content that you generated in an earlier version of the App remains subject to the usage rights that applied to your subscription at the time you generated it.

9.5 Watermark: Results created without Pro carry a "Pencil Sketch" watermark. You may not remove, hide or alter the watermark on a result.

10. Third-Party Services

The App relies on third-party services, including Google Firebase (account and servers), OpenAI (image generation), RevenueCat (subscription management), Google AdMob (rewarded ads), and the Apple App Store and Google Play Store (payments). Your use of these services may be subject to their own terms, and we are not responsible for them. If a third-party service is unavailable, parts of the App may not work.

11. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT
  • WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
  • WARRANTIES REGARDING THE QUALITY, ACCURACY, OR RELIABILITY OF THE APP OR OF AI-GENERATED RESULTS
  • WARRANTIES THAT DEFECTS WILL BE CORRECTED
  • WARRANTIES REGARDING DATA PERSISTENCE, BACKUP, OR RECOVERY
  • WARRANTIES THAT YOUR CREDITS, SKETCHES, OR DRAWINGS WILL BE PRESERVED

WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, OR THAT YOUR DATA WILL BE PRESERVED ACROSS DEVICE CHANGES, APP REINSTALLATIONS, OR OTHER CIRCUMSTANCES. YOUR USE OF THE APP IS AT YOUR SOLE RISK.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUNTEAN HOLDING AS SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
  • LOSS OF CREDITS, SKETCHES, DRAWINGS, OR OTHER LOCALLY STORED DATA
  • DATA LOSS RESULTING FROM DELETING THE APP, DEVICE CHANGES, OR DEVICE RESTORATION
  • DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE APP
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR CONTENT
  • STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE APP
  • ANY OTHER MATTER RELATING TO THE APP

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED (100) NORWEGIAN KRONER (NOK), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY LAW.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Muntean Holding AS, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your access to or use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property and privacy rights
  • Photos and other content you upload or create using the App

14. Termination

You may stop using the App at any time by deleting it and, if you have a subscription, cancelling it as described in Section 5.5. We may suspend or terminate your access to the App, including by disabling your anonymous account, if you violate these Terms, abuse the credit or ad system, or where we are required to by law, or if we stop offering the App.

Upon termination, your right to use the App will cease. Refunds for any unused subscription time are handled by the store as described in Section 8.

15. Changes to Terms

We may modify or replace these Terms from time to time, for example when we add or change features or to comply with the law. The updated Terms will be posted on this page with a new "Last Updated" date, and material changes will be communicated through the App. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms. If you do not agree, you should stop using the App and cancel any subscription.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Norway, except where mandatory consumer protection law gives you the right to bring a claim in the courts of the country where you live.

17. Dispute Resolution

17.1 Informal Resolution: Before filing a claim, you agree to attempt to resolve any dispute informally by contacting us at yolo@illebra.app.

17.2 Binding Arbitration: If informal resolution fails, any dispute shall be resolved through binding arbitration in accordance with Norwegian arbitration rules, rather than in court, to the extent permitted by applicable law.

17.3 Class Action Waiver: To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Muntean Holding AS regarding the use of the App and supersede all prior agreements and understandings, including earlier versions of the Terms (subject to Sections 5.9 and 9.4).
